PowerLister.com and Unique Stuff, Inc. provides this site as an avenue for two or more parties to participate in the sale of legal, personal items. PowerLister, nor Unique Stuff, Inc. will be responsible for any merchandise or payments between parties that are not delivered.

New members are granted a free account to this site. There are no listing fees by this site to submit items, nor are there any commission fees or other administrative fees for Power Lister usage. Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees which may incur for using this site. You are also responsible for paying all applicable fees, costs, taxes, and shipping, and for all hardware, software, service and other costs you incur to bid, buy, procure an item from a seller. We may in our sole discretion add, delete or change some or all of our services at any time.

You are responsible for all fees, payments, and costs associated at any PowerLister website functions. PowerLister does NOT pay any fees, commission, or any other fees that may arise between the buyer or seller. Power Lister fees are independent of all buyer/seller fees, including shipping, tax, etc.

Our site acts as the convenience tool, which only passes information supplied by each member to supported PowerLister advertising websites, for sellers to conduct sales transactions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings or the ability of sellers to sell items. We have no control whether or not sellers will complete the sale of items they offer or buyers will complete the purchase of items they have purchased. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretense at internet sites that act as a medium between parties.

Because we do not and cannot be involved in the actual transaction, in the event that you have a dispute with one or more users, you release PowerLister.com and Unique Stuff, Inc. (and our agents, employees, and associates) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Listings are text descriptions, graphics and pictures on supported ad web sites supplied by you that either;
(a) textually describe the item you are listing for ads, or
(b) link to the text, graphics and picture(s) describing the item you are listing for auction.

Without limiting any other remedies, PowerLister.com and Unique Stuff, Inc. may terminate your account if you are found (by conviction, settlement, insurance or escrow investigation, or otherwise) to have engaged in fraudulent activity in connection with our site.

IN NO EVENT SHALL WE OR OUR ASSOCIATES BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT.

YOU MUST AGREE TO THE TERMS AND CONDITIONS OF THE APPLICABLE ADVERTISING WEB SITE THAT YOU POST LISTINGS THROUGH OUR SITE. EACH AUCTION SITE SUPPORTED BY THIS SITE HAS AN AGREEMENT INDEPENDENT OF THIS AGREEMENT WHICH YOU AGREE UPON BEFORE USING THIS WEB SITE TO POST LISTINGS. IN NO WAY WILL UNIQUE STUFF, INC. OR POWERLISTER.COM BE RESPONSIBLE FOR ANY TYPE OF ACTION THAT A THIRD PARTY MAY TAKE AGAINST YOU OR ANY FEES ASSOCIATED WITH SAID ACTION.

This Agreement shall be governed in all respects by the laws of the State of Florida as such laws are applied to agreements entered into and to be performed entirely within Florida between Florida residents. Both parties submit to jurisdiction in Florida and further agree that any cause of action arising under this Agreement shall be brought exclusively in a court in Panama City, Florida. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
